The Court of Appeal sitting in Kano, has stayed a Federal High Court order against Abia State governor -elect, Alex Otti.
This came as Otti has filed 10 grounds of appeal against the ruling of lower court.
Recall that Justice Yunusa of the lower court had a suit by some aggrieved Labour Party, LP, members, on May 18, 2023, held that the party has no candidates in Kano and Abia states for the governorship poll.
But after the order became public knowledge, the trial judge, however, denied making any order against Abia State Labour Party, having not conducted a valid primary election, saying his order was only against Kano Labour Party.
FrontierNews, however, gathered on Saturday that the motion argued and ruling delivered May 27, 2023, by the Court of Appeal Kano Division in respect of motion for leave to appeal as an interested party against judgment of Kano Division of Federal High court delivered on May 18, 2023 in Suit No. FHC/KN/CS/107/2023.
Leave to appeal within seven days was also granted to Otti, LP sponsored governor-elect in Abia State against the judgment of Justice Yunusa.
Also granted was an order for stay and suspension of the judgment of Justice Yunusa of Kano Division of Federal High court delivered on May 18, 2023, in Suit No. FHC/KN/CS/107/2023, pending the hearing and determination of the appeal for which leave had been granted.
Meanwhile, appellant to give undertaking for damages in the sum of N2millon in favour of each of the respondents in the event of failure by appellant to file or diligently prosecute the appeal in terms of the proposed notice of appeal containing 10 grounds in Exhibit AO4.
