Senior Advocate of Nigeria, SAN, and respected voice in Nigeria’s legal community, Dr. Monday Ubani, has issued a rejoinder addressing concerns raised by Dr. Ope Banwo over the Nigerian Bar Association, NBA, recent acceptance of a N300 million donation from the Rivers State Government.
In his widely circulated article titled “The NBA and the N300 Million ‘Donation’ Mess”, Dr. Banwo questioned the ethical propriety of the donation, suggesting it risked compromising the Bar’s independence.
However, Dr. Ubani, in his counter-piece, described the criticism as “overly idealistic” and “disconnected from operational realities.”
No Legal or Moral Breach
Dr. Ubani argued that no law or professional regulation prohibits such donations, especially when aimed at facilitating the NBA’s Annual General Conference.
He emphasized that similar practices occur across professional bodies nationwide and labeled Dr. Banwo’s position as “emotive, not evidential.”
State Support Is Routine
Highlighting economic realities, Dr. Ubani defended the NBA’s decision, pointing out that most professional associations rely on both public and private sector support for large-scale events. “Is it realistic to fund a multimillion-naira national conference solely from members’ dues in today’s Nigeria?” he queried.
Donations Are Not Bribes
He further asserted that unless evidence proves otherwise, the intention behind the donation was neither politically motivated nor conditional.
“To suggest otherwise without proof is misleading,” Dr. Ubani stated.
Don’t Demonize Benefactors
Dr. Ubani cautioned against demonizing public officials offering support, arguing that partnerships with state governments, handled ethically and transparently, do not inherently threaten the Bar’s independence.
Realism Over Rhetoric
While acknowledging the importance of institutional integrity, Dr. Ubani advocated for a balanced approach combining principle with pragmatism.
“The NBA has not sold its conscience. It has simply accepted a donation, without strings, to advance its professional goals. That, in itself, is not a sin,” he concluded.

Dr. Ubani urged the NBA to establish clear guidelines for future collaborations while maintaining ethical boundaries.
Ubani described the ongoing debate as a healthy conversation rather than a crisis, encouraging continuous dialogue on institutional independence and professional integrity.
